On August 30, 2016, the D.C. Circuit released an opinion in In re: Al-Nashiri, — F.3d —-, 2016 WL 4525274 (D.C. Cir. 2016), which discusses the applicability of Schlesinger v. Councilman, 420 U.S. 738 (1975) to a Guantanamo detainee’s motion to preliminarily enjoin his pending trial before a military commission. At the hearing set for Monday, September 12, 2016 at 9:30 a.m., the Parties shall be prepared to discuss Al-Nashiri and any applicability it has to our analysis in this case.
